End User License Agreement

This End User License Agreement ("EULA") is a legal agreement between you ("User") and Horizon Zero Security ("Licensor") for the use of the HZSec desktop application ("Software"). By installing or using the Software, you agree to this EULA.

1. Grant of License

Licensor grants you a personal, non-exclusive, non-transferable license to install and use the Software on up to 3 devices that you own or control. The Free tier may be used by any individual. The Pro tier license is for a single named user.

The Software is licensed, not sold. Licensor retains all ownership, intellectual property rights, and title to the Software. This EULA does not grant you any rights to trademarks, service marks, or logos of Horizon Zero Security.

4. Pro Tier Subscription

The Pro tier is provided on a subscription basis. Your subscription continues until cancelled. You may cancel at any time, effective at the end of the current billing period. No refunds are provided for partial months, except where required by applicable law.

If your payment fails and is not resolved within 7 days, your account will be downgraded to the Free tier automatically.

5. Updates and Support

Licensor may provide updates to the Software at its discretion. Updates may add, modify, or remove features. Pro subscribers receive priority support via email. Free tier users may access community support.

6. Security Disclaimer

The Software is provided as a security assistance tool only. It is not a substitute for professional security assessment. Licensor makes no representation that the Software will detect all vulnerabilities, prevent all breaches, or that any system using the Software is secure. You remain solely responsible for the security of your systems and code.

Always review AI-generated fix suggestions before applying them. Licensor is not responsible for any damage caused by applying suggested fixes without proper review.

7. Data and Privacy

The Software operates locally on your machine. Your source code and files are not transmitted to Licensor. The Software's AI assistant (Pro only) sends limited findings context to the Anthropic API. See the Privacy Policy at hzsec.io/privacy for full details.

8. Third-Party Components

The Software includes open-source components licensed under their respective licenses. The AI assistant uses the Anthropic API, subject to Anthropic's terms. CVE data is sourced from CISA and NVD (public domain).

9. Warranty Disclaimer

THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL BE ERROR-FREE OR UNINTERRUPTED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SOFTWARE, EVEN IF LICENSOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. LICENSOR'S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE IN THE 12 MONTHS PRECEDING THE CLAIM.

11. Termination

This EULA is effective until terminated. It terminates automatically if you breach any of its terms. Upon termination, you must stop using the Software and delete all copies. Sections 3, 6, 9, 10, and 12 survive termination.

12. Governing Law

This EULA shall be governed by applicable law. Any dispute arising from this EULA shall be resolved through binding arbitration on an individual basis. You waive the right to participate in class action proceedings.

13. Entire Agreement

This EULA, together with the Terms of Service and Privacy Policy available at hzsec.io, constitutes the entire agreement between you and Licensor regarding the Software.
